When a borrower has fallen into default and/or the garnishment status, there are few options available to them to have these statues lifted by their lenders. One option they do have though is called a Rehabilitation Program. A rehabilitation of a loan can take nine months and usually even more. The borrower has to make payments that they have agreed upon with their lenders. Those payments are typically based off income and expenses. They must make nine consecutive monthly payments in order for the lender to lift the default/garnishment status from their loans. If the client is to miss one payment within that nine month time frame then the program needs to be restarted from the beginning. They are able to start the rehabilitation over but they are not permitted to miss any payments. Once the borrower has successfully made nine consecutive satisfactory rehabilitation program payments, the lender will lift the defaulted/garnishment status.

As with most options in default, there are pros and cons. A federal student loan can only be rehabilitated one time. If you have fallen into default twice with a loan and have already gone the route of rehabilitation before, then rehabilitation is no longer an option. If the garnishment process has yet to begin on the defaulted loan, then you may seek consolidation into the William D. Ford Direct Loan Program as an alternative option.

If the garnishment process has already begun on your student loans and you are in a rehabilitation program in efforts to lift the garnishment status you must understand the amount taken from wage garnishment will not be applied to any of the rehabilitation payments. Simultaneously, you have to be garnished from your employer, up to 15 percent of your discretionary income as well as make all the rehabilitation payments on time. Failure to make a rehabilitation payment, will result in you having to restart the program until you have met the amount of consecutive satisfactory payments.

Remember, once you have fallen into the default your lender has sold off the loans to a collection agency to collect payment. Dealing with collection agencies is never the ideal situation but you will have to contact them to get started.
